1. Agreement
These terms govern access to the PropertyLayer website, application, API, bulk data, downloads, documentation, and support services. An order form, checkout term, or signed agreement may add or replace terms for a purchase. If you use the service for an organization, you confirm that you can bind that organization.
2. Accounts and credentials
You are responsible for accurate account information and activity under your account. Keep session and API credentials confidential, give them only to authorized users, and notify PropertyLayer if you believe a credential is exposed. Do not resell or share account access unless a written agreement permits it.
3. Permitted use
You may use purchased data and API results for the internal or product purpose allowed by the applicable order and license. Redistribution, public republishing, resale, sublicensing, and creation of a competing dataset require written permission when they are not expressly included in that order.
4. Prohibited use
Do not interfere with the service, bypass access or usage controls, probe another customer’s account, submit unlawful material, or use the service in violation of law. PropertyLayer data is not a consumer report and may not be used to determine eligibility for credit, employment, insurance, housing, or another purpose governed by the Fair Credit Reporting Act.
5. Public records and data limits
Property records come from public sources that differ by jurisdiction and update schedule. Values may be missing, delayed, or corrected by a source. The service is not a title opinion, survey, appraisal, legal opinion, or substitute for checking the official record. You are responsible for deciding whether the data fits a particular use.
6. Fees and usage
Prices, included records, billing period, renewal, and delivery are stated at checkout or in an order. API usage is measured under the plan rules shown at purchase. Taxes, refunds, cancellation, overages, and renewal language require final approval in the customer-facing terms.
7. Availability and changes
Source coverage, fields, and dates can change. PropertyLayer may modify a service to address source changes, security, law, or product maintenance. Material contract commitments belong in the applicable order or signed agreement.
8. Ownership and feedback
PropertyLayer and its licensors retain rights in the service, documentation, schema, software, and branding. You retain rights in material you submit. If you provide product feedback, PropertyLayer may use it without a duty to pay you.
9. Contract terms requiring approval
Warranty disclaimers, liability limits, indemnity, termination, governing law, venue, assignment, notices, and the contracting entity must be completed and approved before these terms become effective.
10. Contact
Questions about these draft terms can be sent to support@propertylayer.com. The final version must provide the contracting entity’s legal name and notice address.
